These Terms apply only to individuals or entities that (i) register for a Bizdy account, and (ii) subscribe to and pay for Bizdy services ("Subscribers"). These Terms do not apply to casual visitors of the Bizdy website who do not register or subscribe.
You must agree to and accept all of the Terms, or you don't have the right to use the Services. Your using the Services in any way means that you agree to all of these Terms, and these Terms will remain in effect while you use the Services.
We are constantly improving our Services, so these Terms may need to change along with the Services. We reserve the right to change the Terms at any time, but if we do, we will bring it to your attention by placing a notice on the Bizdy website, and/or by sending you an email.
If you don't agree with the new Terms, you are free to reject them; unfortunately, that means you will no longer be able to use the Services. If you use the Services in any way after a change to the Terms is effective, that means you agree to all of the changes.
You may not use Bizdy to send spam or unsolicited email. You agree to comply with all applicable email marketing laws, including but not limited to CAN-SPAM, GDPR, and other relevant regulations.
There are several lines of defense in place to protect Bizdy from spammers. Campaigns matching obvious spam heuristics are terminated along with their associated accounts.
Bizdy uses artificial intelligence to generate personalized outreach messages. You are ultimately responsible for reviewing and approving all messages sent through Bizdy. Bizdy cannot be held liable for the content of AI-generated messages that you choose to send.
If you subscribe to a paid Bizdy account, you will be charged a monthly or annual fee until you cancel your subscription through the proper cancellation process in your account settings.
THE SERVICES ARE PROVIDED "AS-IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
BIZDY SHALL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, OR ANY AMOUNT EXCEEDING THE GREATER OF $100 OR THE AMOUNTS PAID BY YOU IN THE PRECEDING 12 MONTHS.
These Terms are governed by the laws of the State of Delaware. Any disputes shall be brought exclusively in state or federal courts located in Wilmington, Delaware.
